| 内容記述 | 平成20年7月,鳥取県情報公開審議会は,鳥取県教育委員会が行った平成19年度全国学力テストの市町村別,学校別結果の非開示決定につき,原則的に取消すことが相当である旨を同教育委員会に対して答申した.しかし,同教育委員会は再度非開示を決定したこの事案では,(1)答申と再度の非開示決定との内容的不一致の点をどう評価すべきか,(2)情報公開条例に照らし,当該の学力テストの結果は開示されるべきか否か,この二つの問題が提起されている.(2)を次稿の検討課題とし,本稿は先ず(1)の問題を扱っている.本件審議会を含む「`情報公開・個人情報保護審査会」に係る法令の文言,同審査会の調査審議手続等の厳格さ,同審査会の行政過程における位置づけの観点から考察し,同審査会の答申の法的拘束力を否認しつつ,非常に強い事実上の拘束力を肯認するのが妥当であるという結論に至っている.併せて,今後の行政不服審査制度改編の動きの中でも,情報公開,個人情報保護をめぐる不服申立てに係る調査審議には,大きな変化は生じないであろうことを論証している. | |||||||||

| 内容記述 | "Must administrative organs possessing decision-making authority in the process of administrative appeal obey the reports submitted by administrative advisory committees concerning freedom of information or privacy protection? This problem is dealt with in this paper.In the light of legal expressions about those reports , procedure of deliberation and the function performed by those committees , the legal binding force of reports should not be acknowledged. But , at the same time , those reports should virtually be fully appreciated." | |||||||||
